Nabeeta fabricated results to win Jinja East Constituency  seat, Court rules

The Court of Appeal has this morning nullified the election of Nathan Igeme Nabeeta to Parliament and called for fresh elections in Jinja East Constituency.

In a ruling read by Tadeo Asiimwe, three Court of Appeal judges; Steven Kavuma, Richard Butera and Paul Mugamba ruled that voting materials were tampered with greatly influencing the outcome of the 2016 Parliamentary election.

The court ruled that Electoral Commission failed to execute its mandate when election materials where tampered with by people who were not Returning Officers.  Court added that there was evidence of fabrication of results at a number of polling stations.

Court cited Danida A – D polling station where Nabeta’s brother Sulaiman Bansia was the Returning Officer, the judges says evidence has been provided that results were fabricated. At the polling station in question, Nabeta polled 187 votes while his main challenger Paul Mwiru polled 226 votes. However the declaration forms later indicated that Nabeeta won with a total of 507 votes at the said polling station.

Nabeeta had earlier been thrown out by High Court in Jinja, based on a petition filed by Mwiru. He however ran to the appellant court to overturn the judgments.
