When High court on Friday delivers its verdict in a murder case against embattled car rally driver, Desh Kananura and 4 others, stakes are high that he could be exonerated.
This follows two Court assessors Mr Robert Kabureta and Ms Rehema Babirye in their joint lay man’s opinion, advice to court to acquit Desh on grounds that the prosecution failed to prove his role in the murder of Badru Kateregga .
In a session presided over by Justice Joseph Murangira, the assessors equally called for the acquittal of Desh’s brother Raymond Kananura and two of their co-accused Cyrus Maganda and Samuel Muzolewa who are alleged to have beaten Badru Kateregga, a bar attendant to death, over 30,000 shs the deceased had received as a tip from a customer.
Legally, assessors’ opinion is not binding to court because the trial judge can either agree with their advice or depart from it.
The Rally Driver owns the Panamera Bar at Naguru in Kampala where the offense is said to have been committed on September 31, 2012
However, the accused persons have denied the allegations.
Kananura blamed the police for not acting in time to save Kateregga life, his former worker.
