MP Ssematimba’s appeal against dismissal awaiting trial date

The Court of Appeal will hear Busiro North MP Peter Ssematimba’s appeal against his dismissal from parliament after he withdrew application seeking extension of time of filing his election appeal against his dismissal from parliament.

His lawyer Mr Geoffrey Kandeebe informed court that they had withdrawn the application after finding that it was not necessary to go ahead with it.

Lawyers for Ssematimba and his political rival Democratic Party’s Mr Stephen Ssekigizi will return to the court’s registrar tomorrow to discuss modalities for hearing of the appeal and probably set the trial date.

Last week, the National Council for Higher Education (NCHE) vowed to defend Sematimba, whom High court judge Lydia Mugambe found to be lacking an A-level equivalent and subsequently nullified his election and also slapped costs against NCHE for failing to properly evaluate the MP’s A-level equivalent certificate.

NCHE, through its legal department and Wagabaza & Co advocates, filed an independent appeal seeking to set aside the order of costs, among other things.

In his appeal, Sematimba also argues that Justice Mugambe erred in her scrutiny of a certificate of equivalence issued by NCHE.

His appeal will be heard by a panel of three judges.
