Lawyer Alaka’s ‘arrogance’ leads to cancellation of 3 police officers’ bail

The General Court Martial at Makindye has revisited its earlier decision and  cancelled bail for three police officers, Fisal Katende,  Kwarisima Amon and James Magada.

The three police officers had been granted bail in January this year on grounds that they are junior officers who could not interfere with CMI investigations or threaten witnesses.

However, trouble came today when  the head of the seven member court Lt. Gen Andrew Gutti was not amused with the submissions of defence lawyer Caleb Alaka who informed him that his clients will not submit to the jurisdiction of his court as they are not military officers.

Alaka came waving a ruling from the High Court  Civil division in which justice Margaret Oguli-Oumo ordered for the immediate release of the police officers from custody  on grounds that  the Army court acted unreasonably to charge  serving police officers with offenses of being in unlawful possession of firearms yet ,

They need guns in the execution of their duties.

Alaka then asked court to immediately discharge the police officers including the former special operations Unit commander Nixon Agasirwe, Joel Aguma , Benon Atwebembeirwe and Abel Tumukunde adding that they  cannot plead to fresh charges of being in unlawful possession of grenades yet the High court quashed this trial.

It is at this point that   Lt. Gen Gutti informed Alaka  that there is harmony in this country and UPDF will continue respecting the law, and hence forth ordered that all the 7 police officers be remanded to Makindye police military barracks and their  civilian co-accused be taken to Kigo prison until the 27th March 2018.

The accused had reported back to the military court today for the mention of their case.
