Judge Masalu Musene eats own words, returns to treason case against Dr Kiyingi’s in law

Days after he bowed out of the treason case against 18 people including Aisha Nakasibante, a sister in law to Uganda Cardiologist based in Australia Dr Aggrey Kiyingi, High Court’s Justice Wilson Masalu Musene Tuesday convened court and revealed that for the purposed of dispensation of justice, he had decided to hear the case up to its conclusion in order to avoid government resources being wasted on conducting a fresh trial.

Last week, the state prosecution presented a letter from the DPP withdrawing charges against the accused, but this was rejected by defence counsels who wanted the matter to be prosecuted until its logical conclusion.

Accusing the State of playing games with the case, Justice Musene decided to recuse himself and have the matter reallocated to another judge.

But today, he said since nine witnesses have so far testified it will be unfair to accused persons, lawyers, relatives and the court staff who have been attending court for this entire long

The judge adjourned the matter to 7th May 2017 for the prosecution to decide whether to continue with the hearing of the matter or for the defence to make submissions on a No-case-to-answer.

Although the prosecution was not in court today, the judge informed court that they communicated to him seeking an adjournment to next week.
