Ibanda Municipality: Peter Agaba gets High Court backing

The High Court in Kampala has ordered the Electoral Commission to nominate Peter Agaba as a Candidate in Parliamentary Elections for the newly created Ibanda Municipality.

Ibanda is one of the new municipalities that will be holding Parliamentary elections later this month, alongside Bugiri, Apac, Kotido, Sheema, Buikwe and Nebbi.

The Electoral Commission had declined to nominate Agaba on 5th June 2018, on grounds that his nomination papers were not accompanied by evidence of academic qualifications, as required by the Parliamentary Election’s Act-2005.

Agaba petitioned Court, arguing that he appeared for nomination on the designated date with all the required documents, but the Returning Officer refused to nominate him, simply because he didn’t have originals of academic papers.

In his ruling, Justice Musa Ssekaana noted that the presentation of photo copies does not render a person unqualified, since the Provision of the law does not require production of the originals.

Elections in the new municipalities are scheduled for 27th July 2018.
