High Court set for landmark acquitting of Muslim clerics of murder, terrorism

Court assessors have advised the three Justices in the case of the 14 suspects charged with the murder of two Muslim clerics to acquit them.

The assessors gave their opinion to the judges of the International Crimes Division Court this morning.

They told court that Prosecution did not present sufficient evidence to prove charges of terrorism, murder and attempted murder.

Robert Lubega, Judith Muhairwe and Muhammad Ddumba are members of the community who have no legal training but have been attending court and following this case from a  lay man’s point of view.

It’s a legal requirement that before a presiding judge proceeds to write his or her judgment, the assessors advise him on whether to acquit or convict the accused.

However the assessors’ advice is treated as mere opinion with no legal consequence and is not binding to the justices as they write their final judgement.

Court has now set the 11th August 2017 to deliver judgment in the case.

The accused

The other accused persons charged alongside Sheikh Kamoga include; Sheikh Siraje Kawooya, Abdulsalam, Abdulhamid Sematimba, Rashid Jingo, Twaha Sekkitto, Yusuf Kakande alias Abdallah, Sheikh Murta Mudde Bukenya, Kakim Kinene Muswaswa, Muzamilu Kasawuli, Arafa Serunjoji alias Bukenya, Badru Bukenya, Alex Okot, Joseph Olanya, and Amir Kenene.
