The Buganda Road court grade one magistrate, Joan Aciro has acquitted political activist Andrew Karamagi of charges of being a public nuisance citing failure by the state to produce sufficient evidence.
Karamagi was dragged to court for grabbing the speech of the speech of the late former Attorney General, Peter Nyombi at the High Court Premises in Kampala on January 31st 2014.
He pleaded not guilty to the charges forcing prosecution to present five witnesses to implicate him. They included the Investigating Officer, Erias Bairuka, Michael Epecu Ekudu, the bodyguard of the former Attorney General attached to VIPP, Aggrey Mpamizo, a police officer from the Central Police Station Kampala and Robert Tumwesigye, the body guard of Principle Judge, Yorokamu Bamwine.
The late Nyombi also testified against Karamagi.
While delivering her judgment, the Buganda Road Court Grade one Magistrate, Joan Aciro, said the state didn’t produce sufficient evidence to show that the actions by Karamagi were annoying.
She noted that even when one looks at the charge sheet, the charge against Karamagi was inconsistent and not clearly written to secure a conviction.
Aciro also ruled that none of the members of the public who attended the gathering was produced in Court to testify that the actions of Karamagi were annoying and inconveniencing.
She acquitted the Political Activist on grounds that she had looked at the evidence on record and found that Karamagi didn’t resist arrest when he was picked up from High Court by police thereby saying that he staged a peaceful protest against the Attorney General.
