Boda-Boda 2010 leader Abdallah Kitata has been remanded back to Makindye police Military barracks until the 21st May 2018.
This is after the General Court Martial was unable to pronounce itself on his bail application today after the state has opposed to his release.
State prosecutor Capt. Ambrose Baguma has presented before court an affidavit sworn by one of the CMI investigators Maj. Dennis Katambuka stating that there are high chances that Kitata will interfere with witnesses once released on bail since their particulars are already known to him.
Maj. Katambuka also stated that Kitata produced no substantial sureties in court because even his biological father Hajji Muhammad Nabugoba could not tell how old his son is.
For this matter, Maj. Katambuka concluded that Kitata may fail to turn up in court for trial yet he is charged with grave offenses.
The Court’s chairman Lt.Gen. Andrew Gutti said he will rule on this matter on the 7th May 2018.
Meanwhile trial in this case did not proceed after prosecution presented a witness on the stand whose particulars and statement it had not disclosed to defence lawyers.
Private Richard Kasaijja had appeared as prosecution witness number one to pin Kitata and 12 others on offenses of unlawful possession of firearms and Military gear.
Kitata applied to be temporarily released from prison where he has been booked since February /2018 on grounds he has a terrible health condition which ca not be adequately treated while he is on remand at Makindye police Military barracks.
He faces five counts of being in unlawful possession of an SMG gun, 3 pistols and 50 rounds of live ammunition that prosecution states were found on him on 18th/January 2018 at vine hotel in Wakaliga.
