Central Youth MP Kityo over-age queries resurface

Four youth activists from the Central Region districts have threatened to run back to court seeking to recall their newly-elected MP alleging she is above the stipulated age.

Ms Sarah Kityo Babirye, the NRM legislator, has been served with a 5-day ultimatum to vacate her office or face further court battles.

Lead by Hakim Habib Mboowa, the incensed activists have already served the office of the Speaker of Parliament Ms. Rebecca Kadaga with a letter intending to institute legal proceedings before court if Ms Kityo, a former Mukono District youth councillor does not leave her office by next week.

Through their lawyers of United Advocates, the youths  contend that they have evidence in form of a marriage certificate proving that Babirye got  married  to a one Isaac Mukasa at Nakaseke, Luwero in 2006 at the age of 25  and that ten years from then, she cannot be 30 years at the time of her nomination in 2016, among other documents.

They now want her to admit that she is over 35 years and unfit to be a youth MP. They contend that Ms. Kityo’s being in the August House contravenes several provisions of different laws of the Republic of Uganda such as Section 7(7) of the National Youth Council (Amendment) act cap 319, S.15 of the Electoral Commission Act, Articles 61, 78 (1) (c) of the constitution.

Previous court battles

In March, Mr Innocent Kateregga, the Democratic Party youth delegate from Masaka District, and Mr Arthur Katongole from Ggomba District unsuccessfully tried challenging Ms Kityo’s election before Masaka chief Magistrate’s Court.

Citing excerpts from the 2005 High Court ruling by Justice Yorokamu Bamwine during the trial of a defamation case against a government newspaper, he said Ms Kityo told court that she was aged 25 then.

Kateregga further stated that her education background do contradict her claimed age.

In a separate petition, another loser, Mr Katongole, also challenged Ms Kityo’s victory, alleging that it was fraudulently attained upon locking some of his supporters outside the polling venue.
