The Deputy Chief Justice has ruled that over 10 officials including the the Chief of Defence Forces Gen. Muhoozi David (pictured), head of Public Service John Mitala, MPs Moses Balyeku and Margret Kubanga and the Secretary to Treasury Keith Muhakanizi to appear in court in Mbale and be cross -examined in the ongoing age limit case.
Others officials that the petitioners seek court to summon are: police officers Frank Mwesigwa and Asuman Mugyeni, the clerk to parliament Jane Kibirige and the SGT at Arms at Parliament Ahmed Kagoye .
The above parties will be cross-examined on 17th of April 2018
The Petition had sought to add Speaker Kadaga as a key witness, but the Chief Justice has objected to this.
Earlier, the petitioners’ application was objected to by the deputy Attorney General Mwesigwa Rukutana saying there is no justification showed by the petitioners to the effect that the evidence the officials will give in cross-examination will help court reach a just decision.
In any case Rukuntana added that court can rely on the evidence contained in the respondent’s affidavit.
Today, the hearing of the constitutional petition challenging the constitutional amendment scrapping Presidential age limits officially kicked off in Mbale.
