The General Court Martial at Makindye has ordered jailed Boda-Boda 2010 patron Abudallah Kitatta to defend himself on charges of unlawful possession of firearms and ammunition.
This after the 7-member court, led by Lt. General Andrew Gutti unanimously ruled that Kitatta and nine of his co-accused have a case to answer, and must explain how they acquired the guns and bullets.
The court has ruled that having addressed its mind on the law and evidence of the 4 prosecution witnesses, it’s satisfied that prosecution has made out a case against Kitatta and ten others, and ordered that they present their defence on 7th January 2019.
However, the same court has acquitted and set free 3 out of the 13 suspects on charges of unlawful possession of military uniforms and caps, which were allegedly recovered from the offices of Boda-boda 2010 at Wakaliga in Rubaga Division.
General Gutti explained that prosecution brought sufficient evidence that Kitatta owned vehicle registration number UAK 135B in which an SMG rifle and a golden pistol all loaded with live ammunition were found.
The court has also ruled that in this same car Kitatta’s co-suspects; Sowedi Ngobi and Ibrahim Sekajja who were allegedly taking direct orders from Kitatta to obstruct an operation by CMI officers were found seated with a loaded SMG gun for which they must also offer an explanation for.
After the court ruling; Kitatta and the nine has asked the court for more time to discuss with their lawyers and decide on which option to take while defending themselves.
The Group also says they have witnesses to call in their defence and will also bring footage from the surveillance camera at Vine Hotel in Wakalika where prosecution claims to have arrested Kitatta from one of the hotel rooms with a golden pistol.
Kitatta and his group has now been remanded back to Makindye Military  police barracks and Luzira prison respectively from where they will spend this year’s festive season
