Bagyenda fails to reach deal with state over murdering his girl

Brain Bagyenda; the jailed son to Internal Security Organisation Director Colonel Kaka Bagyenda has failed to reach a plea-bargain deal with the state, in relation to charges of murdering his girl friend Enid Twijukye.
High Court judge Anthony Ojok Ayu had given both the state and Bagyenda’s lawyer Nsubuga Mubiru a week to negotiate the appropriate sentence for the accused, in exchange for a guilty plea.
However, when the matter came up before the magistrate this morning, State prosecutor  Joseph Kyomuhendo informed court that there was no breakthrough in negotiations between him and Bagyenda’s lawyer.
He, therefore, asked court to set a date for him to produce his witnesses against the accused.
However, Defence Lawyer Nsubuga Mubiru has attributed the failure of negotiations to prosecution’s refusal to provide a psychiatric report from Butabiika hospital, where he claims the accused had been admitted for treatment before committing the gruesome murder.
Mubiru added that his client opted for plea-bargain because of his unstable mental condition.
In February last year, Bagyenda a Pharmacist together with Bainomugisha Innocent; a cleaner and Vincent Rwahwire a casual labourer, all residents of Kimwanyi zone in Luzira Nakawa Division, were arraigned before Nakawa court and charged with the murder of Enid Twijukye; a 22-year-old student of Ndejje University.
The prosecution says the trio committed the offence at Njobe road in Luzira Nakawa Division, at the home of Brian Bagyenda, before dumping Twijukye’s body in Namanve forest, where it was later recovered by police.
The case has now been adjourned to 14th January 2019, after Defence counsel asked for another two weeks to continue negotiations for a lighter sentence for his client.
Meanwhile, the other two co-accused have informed court that they are not interested in a plea bargain.
