Justice Elizabeth Musoke could be kicked off panel of justices to hear the contentious Age Limit Petitions at Mbale High Court from 9th April over siring children with President Museveni ministers.
Just hours after the Deputy Chief Justice Alfonse Owiny Dollo announced that he will be working with Justices Remmy Kasule, Kenneth Kakuru, Cheborion Barishaki and Elizabeth Musoke, a petitioner – lawyer Male H. Mabirizi challenging the removal of the age limit from the constitution has accused Ms. Musoke of siring kid with two cabinet members.
He accuses her of siring a kid with Deputy Attorney Mwesigwa Rukutana and siring two with Hillary Onek, minister for general duties in the office of the Prime Minister.
“I am the petitioner in the Constitutional petition No. 49 of 2017-which has been consolidated with four others and coming up for hearing on 9th April 2018 at Mbale- Male H. Mabirizzi K. Kiwanuka V. The Attorney General of Uganda,’’ Mabirizzi penned.
The lawyer says, the Judge will be receiving submissions from the father of her child and at the same time,
‘‘.. she will be hearing a case in which another father of her two children Hon. Hillary Onek is interested in and having voted in support.’’
Mr. Mabirizi told TheUgandan on Wednesday that his team is simply unearthing other people’s secrets in defence of the country’s constitution.
“If you sire a child with the deputy Attorney General, you can’t preside over the case for the constitutional amendment appeal,” he said. “It is conflict and you will be sitting in your own case.”
Last week, the Deputy Chief Justice announced that the five petitions filed by the Uganda Law Society (ULS), six opposition MPs , lawyer, Male Mabirizi, Dr.Abed Bwanika and Prosper Busingye, a concerned citizen from Western Uganda had been merged into one.
He later announced that hearing had been transferred to Mbale and that it would be done in a marathon style but this didn’t not go well with the petitioners who complained of the long distance and inconvenience.
The Parties also agreed on a number of issues for the Court to determine- these include: whether it was within the law for parliament to extend the terms for MPs and Local Council leaders from 5 to 7 years; whether it was right for the legislators to extend conducting of the next General Elections from 2021 to 2023; and whether Parliament was right to remove the constitutional upper age cap of 75 years for those intending to run for president.
