5 murder suspects set free by a Rukungiri Court

Tension is high at Rukungiri law courts after five men who had been arrested and arraigned in court in connection with the brutal murder killing a security guard in 2013 were set free for lack of evidence.

Mugarura Anthony, Kabasharira John, Atwebembeire Allan, Ahereza Innocent and one other, all residents of Kiganda in Nyakishenyi, who have been on remand for the last 36 months, were freed on Thursday by High Court judge Kawumi Kazibwe.

When arraigned in court in January 19th the accused were found not guilty of the offence of murder because prosecution failed to place then at the scene of crime and the case was poorly investigated.

Releasing the suspect, Justice Kawumi said pegged on the fact that there is no evidence adduced in court, there was no need for the accused to continue being remanded in Rukungiri central prison.

The Prosecution told the hushed packed court the accused were guilty of killing a one Sostine a night watchman at Kiganda COU in Nyakishenyi in 2013 but the investigating police officers have not found tangible evidence to charge the five for any offence. Their two witnesses; Rev Kanyehimba Jackson said that he was called to see the dead while Turyatemba Johnson said he did not know who killed.

Justice Kawuma concurred with the defence lawyer Jonathan Bwagi that the case was poorly investigated since the idenfication parade was done by LCs in absence of police and then set the five free.
